This book was released on 2012-09-03 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government responded to the Family Justice Review (Norgrove report, November 2011, ISBN 9780108511158) in February 2012 (Cm. 8273, ISBN 9780101827324). The current system is characterised by delay, expense, bureaucracy and lack of trust. This paper sets out the draft legislation to bring the Government's policies into effect. The proposals would reduce delay and duplication, with a maximum time limit of 26 weeks for completing care and supervision proceedings. Case management decisions would have to consider the impact on the welfare of the child, and the courts should focus only on the provisions of the care plan that set out the long term plan for the upbringing of the child. The legislation covers: family mediation information and assessment meetings; child arrangements orders; control of expert evidence, and of assessments, in children proceedings; time limits in proceedings for care or supervision orders; care plans; care proceedings and care plans, regulations and procedural requirements; repeal of restrictions on divorce and dissolution etc where there are children; repeal of uncommenced provisions of Part 2 of the Family Law Act 1996.

Available in PDF, EPUB and Kindle. Book excerpt: Does a justice system have a welfare function? If so, where does the boundary lie between justice and welfare, and where can the necessary resources and expertise be found? In a time of austerity, medical emergency, and limited public funding, this book explores the role of the family justice system and asks whether it has a function beyond decision-making in dispute resolution. Might a family justice system even help to prevent or minimise conflict as well as resolving dispute when it arises? The book is divided into 4 parts, with contributions from 22 legal scholars working across Europe, Australia, Argentina and Canada. - Part 1 looks at what constitutes a family justice system in different jurisdictions, and how a welfare element is included in the legal framework. - Part 2 looks at those engaged with a family justice system as professionals and users, and explores how far private ordering is encouraged in different countries. - Part 3 looks at new ways of working within a family justice system and raises the question of whether the move towards privatisation derives from the intrinsic value of individual autonomy and acceptance of responsibility in family disputes, or whether it is also a response to the increasing burden on the state of providing a welfare-minded family justice system. - Part 4 explores recent major changes of direction for the family justice systems of Australia, Argentina, Turkey, Spain, and Germany.

Summary Book Review After the Act :

Download or read book After the Act written by Mavis Maclean and published by Bloomsbury Publishing. This book was released on 2019-04-18 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: After the Act describes the aftermath of the recent removal under LASPO of public funding from legal services in family matters other than in defined cases such as child protection and domestic abuse. Through analysis of the policy context, interviews with key players, observation of services provided by lawyers, students, lay support workers and the advice sector, the authors outline the work being done and the skills being used in a range of settings. The book raises questions not only about access to family justice, but about the role of law in family matters in an increasingly post-legal society. Fragmentation of the market in the new services offering information, initial advice, online or alternative dispute resolution – but rarely ongoing casework – raises questions about where costs fall and how quality can be assured. Many of these services are forms of private ordering, where outcomes are hard to assess. If neither the state nor the individual can afford full legal services where the best interests of any child involved are of paramount importance, and lawyers negotiate to make best use of the resources available, perhaps it is time to consider using lawyers differently, with lay support, to solve problems before they become disputes.

Book excerpt: Over the past two decades, virtually all areas of family law have undergone major doctrinal and theoretical changes - from the definition of marriage, to the financial and parenting consequences of divorce, to the legal construction of parenthood. An equally important set of changes has transformed the resolution of family disputes. This 'paradigm shift' in family conflict resolution has reshaped the practice of family law and has fundamentally altered the way in which disputing families interact with the legal system. Moreover, the changes have important implications for the way that family law is understood and taught. This volume examines the contours of this paradigm shift in family conflict resolution and explores its implications for family law scholarship and practice. The interdisciplinary compilation includes contributions from lawyers, legal academics, social scientists and mental health professionals. As the articles in the volume demonstrate, the transformation in family conflict resolution holds considerable promise for disputing families, but it also raises a number of challenges. These challenges include concerns about the institutional competence of courts, the surrender of fact-finding and decision-making to individuals without legal training, the loss of autonomy and privacy for family members subject to continuing court oversight and the disjunction between problem-solving justice and authoritative legal norms. By exploring both the promise of the new paradigm and its potential pitfalls, this volume engages family law scholars and offers insights to judges, practitioners and policy makers responsible for serving families in conflict.

I felt it important to understand what it is and where it came from as a feature of human society, of human life. I wound up in a department of education, perhaps quite fortuitously, for education enabled me to examine how experiences of justice or injustice in various educational settings shape children and young people's values, behaviors, and chances for living a decent future life"--
